2. What this warranty covers
This Warranty covers manufacturing defects in materials and workmanship supplied by MS Gates where the defect materially affects the structure, safe use or normal operation of the gate or gate system.
This Warranty applies only to goods supplied by MS Gates and only where the goods have been used, maintained and serviced in accordance with these Warranty terms and any instructions given by MS Gates.
Unless agreed otherwise in writing, this Warranty applies to domestic use only.
This Warranty applies only to the original purchaser and is not transferable to any later owner, occupier, tenant, buyer or third party.
3. Warranty period and start date
The structural warranty period is 4 years from the warranty start date.
The Warranty starts only when all of the following conditions have been met:
- the full invoice has been paid in cleared funds;
- the goods have been supplied or installed by MS Gates;
- the customer has complied with the payment and warranty conditions;
- where warranty registration is requested by MS Gates, the warranty has been registered successfully.
No warranty cover applies before full payment has been received.
If any payment remains outstanding, MS Gates may refuse warranty service, servicing, repair, diagnostics, call-outs or replacement until the account is paid in full.
4. Installation acceptance
Where MS Gates carries out installation, the customer should inspect the installation upon completion and raise any visible concerns immediately.
Payment of the final invoice or final installation charge confirms that the customer has had a reasonable opportunity to inspect the works and accepts the installation as complete and in accordance with the agreed specification, subject to any rights that cannot be excluded by law.
By making final payment, the customer confirms that, unless concerns have already been raised in writing:
- the installation has been inspected;
- the works appear complete;
- the works match the agreed specification;
- no further changes, adjustments or modifications are requested at that time.
Any changes, alterations, adjustments or additional works requested after final payment, and not caused by a confirmed MS Gates defect, may be treated as chargeable works.
5. Warranty remedy
If MS Gates confirms that a valid warranty defect exists, MS Gates will decide the most appropriate remedy.
The usual remedy under this Warranty will be one or more of the following:
- repair of the affected part;
- localised refinishing or adjustment;
- replacement of the defective component with an equivalent or suitable alternative;
- supply of a replacement part where appropriate.
This Warranty does not provide an automatic right to a refund.
The remedy will depend on the nature of the issue, the age of the product, the cause of the issue, the part affected, whether the product has been maintained correctly and whether the issue falls within this Warranty.
Nothing in this section limits any legal rights that cannot be excluded by law.
6. Fault assessment, inspection and manufacturer testing
If a part or component is reported as faulty, MS Gates may require photographs, videos, a description of the issue, access to the site, inspection of the product, diagnostic testing or removal of the affected part.
Where a third-party component is suspected to be faulty, MS Gates may remove the component and send it to the original manufacturer, supplier or specialist for inspection and assessment.
Warranty remedies apply only after MS Gates, the supplier or the manufacturer confirms that the issue is a manufacturing defect or a defect covered by this Warranty.
If the component is found not to be defective, or the issue is excluded under this Warranty, the customer may be charged for associated costs, including call-out, diagnostics, labour, removal, refitting, testing, carriage, manufacturer inspection, return transport and repeat visits.
7. Anti-corrosion finish, paint system and surface appearance
Unless agreed otherwise in writing, the standard MS Gates finish for steel gates is an anti-corrosion paint system consisting of high zinc primer and a 2K polyurethane topcoat.
This finish is designed to provide practical corrosion protection for made-to-measure steel gates, while reducing the risk of distortion that may occur with some hot-dip galvanising processes on large sliding or cantilever gates.
Due to the nature of steel fabrication, welding, surface preparation, priming and paint application, the following are considered normal characteristics and do not automatically constitute defects:
- minor surface marks;
- small texture variations;
- small runs, drips or local paint build-up;
- slight ripples or unevenness in the finish;
- minor differences in gloss or shade;
- local touch-in areas or finish variations;
- visible weld areas, edges or fabrication details;
- natural fading, weathering or colour change over time.
The final appearance of the finish may vary depending on the gate size, steel profile, fabrication method, surface preparation, colour, lighting, viewing angle and environmental exposure.
Hot-dip galvanising, galvanising with 2K paint finish, or galvanising with powder coating are not supplied as standard by MS Gates. These options may only be considered where specifically requested by the customer and agreed by MS Gates in writing before the order is accepted.
Where galvanising or powder coating is requested, the customer accepts that these processes may involve additional risks and limitations, particularly on large sliding or cantilever gates. These may include distortion, twisting, surface imperfections, zinc build-up, drainage marks, venting marks, rough areas, excess material inside profiles, fitting issues, track or guide problems, roller issues and additional adjustment or remedial work.
MS Gates does not recommend galvanising with powder coating for large sliding or cantilever gates unless the customer fully understands and accepts the possible risks and limitations of the process.
Surface appearance issues that are inherent to the agreed finishing process, result from normal ageing, or fall within reasonable manufacturing and finishing tolerances are not treated as warranty defects.
8. Rust, corrosion, coating damage and wear and tear
This Warranty does not cover small or surface rust, normal wear and tear, or corrosion caused by damage, neglect, lack of maintenance, environmental exposure, misuse or third-party interference.
Small signs of surface corrosion may appear over time on any external steel product, particularly on edges, welds, joints, drilled holes, fixings, moving parts, contact points, areas exposed to friction, areas where the coating has been scratched or chipped, or areas where water, dirt, salt, moss, algae or other contaminants can collect.
Rust, corrosion or coating damage is not covered where it is caused or contributed to by:
- scratches, chips, impact or abrasion;
- vehicle damage;
- installation, adjustment, repair or modification by third parties;
- drilling, cutting, grinding or other work carried out after delivery or installation;
- lack of cleaning or maintenance;
- aggressive chemicals, salt, fertilisers or unsuitable cleaning products;
- coastal or high-exposure environments;
- standing water, blocked drainage, trapped dirt or debris;
- damage caused during transport, storage or handling after delivery;
- normal ageing, fading or weathering of the coating.
The customer is responsible for keeping the gate clean, inspecting the coating periodically, and touching in any chips, scratches or exposed metal as soon as reasonably possible to reduce the risk of corrosion.
Where the customer uses the annual warranty service provided by MS Gates, small localised signs of corrosion, minor chips or minor coating imperfections may be assessed and, at MS Gates' discretion, locally cleaned, protected or touched in as part of the service, provided they result from normal use and are not caused by damage, neglect, misuse, third-party work or lack of maintenance.
Such minor local touch-ins carried out during a warranty service are treated as normal maintenance of an external steel product and do not automatically mean that the product was defective.
If MS Gates confirms that corrosion has been caused by a defect in its own workmanship or materials supplied by MS Gates, the issue will be assessed under this Warranty. The usual remedy will be repair or localised refinishing of the affected area, unless MS Gates considers another remedy appropriate.
This Warranty does not guarantee that any external steel product will remain completely free from all surface rust, marks, fading or natural weathering for the full warranty period.
9. Composite, timber and infill movement
This Warranty does not cover natural movement, ageing or appearance changes in composite, timber or similar infill materials.
The following are not normally treated as warranty defects:
- minor warping;
- slight bowing;
- shrinkage;
- expansion;
- twisting;
- fading;
- colour variation;
- surface weathering;
- movement caused by temperature or sunlight.
Composite and timber products may change over time due to heat, sunlight, moisture, seasonal changes and normal external exposure.
Where infill boards, timber sections or composite materials are supplied by a third-party manufacturer, any manufacturer warranty may apply separately.
10. Extreme weather and unsafe conditions
During extreme weather or unsafe conditions, gates should be used carefully and, where appropriate, kept closed and secured.
Automated gates should not be operated unnecessarily during severe wind, storms, flooding, ice, snow or other unsafe weather conditions.
Damage caused by failure to use the gate responsibly during extreme weather is not covered by this Warranty.
This Warranty does not cover damage caused by strong winds, storms, flooding, ice, snow, lightning, falling branches, flying debris, fire, extreme temperatures or other weather-related or environmental events outside MS Gates' reasonable control.
11. Annual servicing requirement — automation and electrical components
To maintain warranty cover for automation and electrical components, an annual service by MS Gates is required.
The annual service must take place within each 12-month period from the warranty start date.
The annual service cost is £180 + VAT, unless agreed otherwise in writing.
If the annual service is missed, refused, overdue or not paid for, warranty cover for automation and electrical components may be suspended or excluded.
Where annual servicing is not maintained, the following may be excluded from warranty cover:
- motors;
- control panels;
- wiring;
- photocells;
- safety edges;
- keypads;
- intercoms;
- video intercoms;
- access control systems;
- remote control receivers;
- transmitters;
- electrical accessories;
- other automation or electrical parts.
Failure to maintain annual servicing does not automatically remove the structural warranty for the gate leaf or gate posts, provided the issue is not caused by misuse, lack of maintenance, impact, weather, third-party work, ground movement or another excluded cause.
12. Moving parts, consumables and short-life components
This Warranty does not cover normal wear and tear of moving parts, small accessories or consumable components.
The following items are not covered for the full structural warranty period:
- push buttons;
- switches;
- key fobs;
- remote controls;
- transmitters;
- batteries;
- bulbs;
- small access control accessories;
- user-replaceable consumables.
Intercoms, video intercoms and similar electronic communication systems are covered for 12 months from the warranty start date, unless the manufacturer provides a longer warranty or MS Gates agrees otherwise in writing.
Remote controls, key fobs and batteries are treated as consumable or short-life items and may be chargeable if replacement is required.
13. Cleaning and general maintenance
The customer must keep the gate and operating area clean, clear and reasonably maintained.
The gate should be kept free from dirt, debris, leaves, moss, algae, salt, mud, stones, obstructions and any material that may affect movement, drainage, coating or safe operation.
The customer should regularly check that the gate can move freely and that no object is blocking the movement area, guide system, wheels, rollers, photocells, safety devices or closing area.
Neglect, lack of cleaning or lack of reasonable maintenance may affect or invalidate warranty cover.
14. Walls, pillars, foundations and supporting structures
MS Gates is not responsible for failure, movement, cracking, instability or damage caused by walls, pillars, foundations, posts, surfaces or supporting structures that were not supplied and installed by MS Gates.
The customer is responsible for ensuring that any existing wall, pillar, foundation, post, concrete base, ground structure or fixing surface is suitable, stable and fit for purpose.
This Warranty does not cover issues caused by weak walls, unstable pillars, poor foundations, ground movement, settlement, subsidence, drainage issues, cracked masonry, poor brickwork, movement of existing structures, or surfaces or supports not prepared by MS Gates.
Any adjustment or remedial work required because of movement or failure of structures not supplied and installed by MS Gates may be chargeable.
15. Exclusions

This Warranty also does not cover cosmetic issues that do not materially affect the structure, safety or normal operation of the gate, unless MS Gates confirms that the issue was caused by a defect in its own workmanship or materials.
16. Limitation of liability
MS Gates' liability under this Warranty is limited to repair, localised refinishing, adjustment, replacement of the affected component or another remedy that MS Gates considers appropriate.
To the extent permitted by law, MS Gates' total liability under this Warranty is limited to the original purchase price of the affected goods.
MS Gates is not responsible for indirect loss, consequential loss, loss of profit, loss of business, loss of opportunity, inconvenience, third-party costs or other losses not directly caused by a confirmed warranty defect.
Nothing in this Warranty excludes or limits liability where it would be unlawful to do so.
17. Consumer rights
Nothing in this Warranty affects the customer's statutory rights under the Consumer Rights Act 2015 or any other rights that cannot be excluded by law.
This Warranty is an additional limited warranty provided by MS Gates. It does not replace statutory rights where those rights apply.
18. Governing law and jurisdiction
This Warranty is governed by the laws of England and Wales.
Any disputes relating to this Warranty will be subject to the courts of England and Wales, unless applicable law provides otherwise.
19. Warranty acceptance and registration
By purchasing goods or services from MS Gates, the customer confirms acceptance of this Limited Warranty, the MS Gates Terms & Conditions, the quotation, the order specification and any written documents forming part of the order.
